About this event

JURY ASSEMBLY ROOM $60 FBA Members | $90 Nonmembers | $40 Government 2 hours CLE credit pending

Temporary restraining orders and preliminary injunctions present a unique challenge for litigators. The stakes are high, the timetable is compressed, and there is often little opportunity to figure out the process as you go. In the Eastern District of Virginia—where the pace of a case is already fast—knowing what to expect can be especially important.

Join FBA-NOVA for a practical discussion of temporary restraining orders and preliminary injunctions in the EDVA, from both the practitioner’s and the Court’s perspectives. The program will walk through what counsel should know when seeking—or responding to—a TRO or preliminary injunction, including the procedural and practical considerations that arise from the moment an application is filed through briefing, presentation to the Court, and resolution of the motion.

Panelists

Hon. Michael S. Nachmanoff | U.S. District Judge Craig C. Reilly | The Law Office of Craig C. Reilly

Moderator Cailyn Reilly Knapp | McDermott Will & Schulte

Whether you are contemplating emergency relief or suddenly find yourself defending against it, this program is designed to give you a practical roadmap for navigating TROs and preliminary injunctions in the Eastern District of Virginia.

Topics will include:

• Getting Started: What should counsel do when a client needs emergency relief or when an emergency motion is filed against your client?

• Filing and Procedure: How TRO and preliminary injunction requests get before the Court, including filing and scheduling considerations.

• Inside Chambers: What happens after an emergency request reaches the Court, how chambers approaches expedited motions, and what judges need from counsel.

• Presenting the Motion: Practical guidance on briefing, evidence, witnesses, hearings, and effectively presenting or opposing a request for injunctive relief.

• EDVA Practice: How the process may differ among chambers and what practitioners should know about handling emergency motions on the Rocket Docket.
